One of the most frequent requests from our clients is for assistance in executing a Last Will and Testament. A Last Will and Testament is a critical piece of any estate plan, and if done properly, it can save families a lot of heartache and confusion when a loved one passes away. While it is rarely helpful for a Will to be the only part of an estate plan, it is usually the foundation on which all other estate planning documents are built.
A Last Will and Testament expresses the wishes of an individual as to how they would like their estate and assets to be distributed once they have passed away. In most cases, beneficiaries of a Will are spouses, children, other close family members, and in some cases the beneficiary may also be a charity or an organization.
Another crucial component of writing a Last Will and Testament is the naming of a guardian for a minor child. This is a moment no parent wants to consider but it is absolutely vital for the parents of minor children to insure that the person they trust most, (which sometimes may not be the person next in line according to the Probate Court), will be entrusted with the care and wellbeing of their children.
