Guardianship Attorney / Conservatorship Attorney

Our attorneys can help you navigate through the court appointed process when a loved one lacks capacity or is unable to help themselves.

If proper estate planning documents, such as a Health Care Proxy and a Durable Power of Attorney have not been put in place and an individual is determined to be incapacitated, a guardianship and/or conservatorship petition may be needed. A Guardian has the authority to make healthcare decisions for an individual while a Conservator has the authority to make legal and financial decisions for an individual. In order to become a Guardian or Conservator, you must file a petition with the Probate Court.

The process of having to go through the Probate Court can be avoided with proper estate planning documents/preemptive estate planning, however, in the event that a petition is necessary, Falco & Associates, P.C. offers a range of Guardianship Attorneys and Conservatorship Attorneys to help assist your loved ones in a time where they are unable to help themselves.
