Estate planning is crucial for families who have a loved one with special needs or disabilities. While every individual is unique in their circumstances and level of care and financial needs, the team at Falco & Associates, P.C. strives to assist clients in custom tailoring an Estate Plan to reflect these needs.
A Special Needs Trust Attorney (we actually call these Supplemental Needs Trusts in our office) is created to provide for a loved one with a certain disability that receives benefits for said disability from the state or government. As a way to protect the current benefits your loved one may already be receiving for said disability, a Special Needs Trust holds the distribution (inheritance or gifted money) separately in the special Trust, as not to disrupt or conflict with current benefits.
The purpose of this Trust is to provide your loved one with supplemental care, maintenance, support and education in addition to and over and above the benefits they may already be receiving from any local, state, or federal governmental, or from any private agencies, any of which provides services or benefits to your loved one. The Special Needs Trust Attorneys at Falco & Associates, P.C. aim to improve the quality of life of your loved one with special needs or disabilities without disqualifying them from public benefits.
