If proper estate planning documents, such as a Health Care Proxy and a Durable Power of Attorney have not been put in place and an individual is determined to be incapacitated, a guardianship and/or conservatorship petition may be needed. A Guardian has the authority to make healthcare decisions for an individual while a Conservator has the authority to make legal and financial decisions for an individual. In order to become a Guardian or Conservator, you must file a petition with the Probate Court.
